Common Tactics Employed by Doctors & Defense Lawyers
A common tactic among defense lawyers and the doctors that they hire is
to claim that the pain a client is suffering after an accident is as a
result of a pre-existing, degenerative condition (wear and tear). This
is merely a smoke screen used by unscrupulous doctors to deny victims
proper compensation. The truth is that nearly every adult has some amount
of degenerative change in their spine. However, degenerative changes are
irrelevant if they are not causing some sort of pain or symptoms. It is
common for a person with degenerative changes in their spine to suffer

What is a Herniated Disc?
When you hear the term herniated disk, a physician is referring to the
rubbery disks between your vertebrae that act as shock absorbers. Trauma
can cause these disks to either bulge or herniate. A bulging disk is when
the outer portion of the disk is deformed. A herniated disk is when the
annulus (inner portion of the disk) is pushed out through a fissure in the disk.
Herniated and bulging disks become symptomatic when they encroach on the
nerve roots. This encroachment can cause pain, numbness, tingling, and/or
weakness in either the arms or legs. Steroid injections are often prescribed
in order to reduce the inflammation in the area of the disk. Decreasing
the swelling creates more space in the area of the injured disk and nerve
roots. This, in turn, can result in a reduction or elimination of symptoms.
