We represented an 8 year old girl in Washington, DC who was hit in the nose by her teacher, causing her a bloody nose. The teacher claimed that the conduct was accidental. The District of Columbia claimed that the teacher was not acting within the scope of her job duties and it was therefore not responsible. We were able to prove that the teacher was attempting to discipline the student at the time she was hit in the nose and therefore the striking was within her duties.
As a result we obtained a settlement of $37,500 for the child, and a full waiver of the Medicaid lien.
