A client in Fairfax, Virginia tripped and fell at a major department store. She was at a register when the cashier asked our client to show her where she had found the item she was attempting to purchase. As our client walked from the checkout counter, her foot became entangled in a portable clothing rack causing her to trip and injure her wrist, shoulder, and foot.
The store denied responsibility, pointing out that her shoulder injury wasn't diagnosed until two years after the accident and that the clothing rack was five feet high and six feet long and therefore easily seen and avoided. The store also claimed that many of our client's injuries were not related to her fall. Nevertheless, we filed suit against the store and, after prolonged litigation, obtained a settlement of $75,000.
