The Effect of Uber on Accidents

Uber is a popular ride sharing service that provides automobile transport to its customers in the suburbs and in Washington, D.C. If you are in an automobile collision with an Uber driver, the claims process is slightly different from a typical car accident claim.

Uber drivers are not covered under their personal automobile insurance policies if they were working as a driver for Uber at the time of the collision. The second thing to remember is that instead of negotiating a settlement with the insurance adjustor provided by Uber, claims involving Uber drivers are adjusted by a third party claim manager at James River Insurance Company. These claim managers work in conjunction with Uber and Raiser, LLC to negotiate a settlement, and typically the claims manager must get authority to settle claims in advance of negotiation and re-negotiations. It is important to understand this before they take place.

Once that is resolved, the claim can proceed as would any other claim. However, it is important to remember that Uber drivers are not legally considered employees of Uber, and therefore your claim should be against the driver (covered by Uber’s insurance) but not against Uber itself.
