The article discusses how to deal with insurance companies when seeking compensation after a collision – a tricky task in most cases considering the lengths insurers will go to avoid losing money. Knowing the value of a claim and having a desired settlement in mind before entering into negotiations is critical, and can increase the likelihood of receiving a fair payout.

If an accident victim is offered less than the estimates they have received, they don’t necessarily have to file a lawsuit. According to Mr. Simeone, it is in the best interests of both the driver and the insurer to “avoid the cost and inconvenience of continued litigation.” If the driver feels the initial offer is inadequate, they are completely able to decline and ask for a better offer without having to sue.

Mr. Simeone also weighed in on how the state you live in can affect your ability to receive compensation after an accident. For example, in Washington, DC, a driver must be 0% at fault for an accident in order to receive any compensation, while in other states, like Georgia, a driver need only be less than 50% at fault for an accident to receive compensation.

When it comes to deciding whether or not to hire an attorney after an accident, Mr. Simeone points out that an attorney is beneficial in cases where the payout that is being sought is greater than attorney fees. For smaller claims, an attorney is not necessary.
