When Can You Be Arrested at a Store? Attorney Thomas Simeone Interview on the Legality of Store Arrests

Have you ever been arrested on a business property or had the business owner call the police on you?

Unfortunately, many business owners call police to deal with customers who may not necessarily be acting out. Sometimes business owners do this in order to intimidate or harass people of a certain age, race, or other protected status.

In a recent article from Elliot, a consumer advocacy site, journalist Christopher Elliot dives into many of the questions about making arrests on business property after Philadelphia police arrested 2 men in a Starbucks several weeks ago. In the article, he got Attorney Tom Simeone’s take on the legality of such arrests:

“If a store calls the police in good faith (meaning they have a legitimate reason to believe a law is being violated), there will likely be no legal penalty for doing so.” Simeone goes on to explain, “However, if [the business owners] act in bath faith, are dishonest, or use the criminal legal process improperly, they can be held liable for malicious prosecution, defamation, and possible other legal violations.
