As a leading accident attorney, Thomas J. Simeone of Simeone & Miller is often reached for comment by the media. He was happy to share his expert advice on “How to Handle the Aftermath of a Car Accident and Negotiate Insurance” with MoneyGeek Journalist Mark Fitzpatrick.

In the MoneyGeek article, Attorney Simeone discussed what to do if you are involved in a car accident in another state—specifically, in no-fault states that require drivers to have personal injury protection (PIP) insurance. In these places, like Washington, DC, insurance companies will not consider who is at fault for an accident when processing an insurance claim. This allows anyone injured in an accident to recover compensation for their injuries and damages. (In most states, like Maryland and Virginia, an accident victim may recover compensation only if they can prove the other driver was at fault for the accident.)

So what happens when a driver from Maryland (an at-fault state) gets into an accident in Washington, DC (a no-fault district)?

“Most insurance policies state that the coverage provided increases to match the requirement of any state you visit,” Attorney Simeone explained. “That allows you to visit other states without fearing that you do not have the required insurance. If you are in a no-fault state, the damages you are entitled to may be limited by that state’s laws, but you should be protected if you are at fault.”

Next, Attorney Simeone delved into how to navigate the insurance claims process if you were involved in an accident while borrowing someone else’s car.
