Navigating car insurance requirements can be challenging, especially in a region as unique as the DC Metro area, which includes Washington, D.C., Maryland, and Virginia. Each jurisdiction has its own specific laws and regulations, making it essential for drivers to understand their obligations to remain compliant and adequately protected. At Simeone & Miller, LLP, our personal injury attorneys are here to help you make sense of the requirements and ensure you’re equipped with the knowledge to stay covered on the road.

Washington, D.C. Car Insurance Requirements

Washington, D.C. mandates that all drivers carry a minimum amount of car insurance to operate a vehicle legally. The required coverage includes:

Liability Insurance:

  • $25,000 per person for bodily injury
  • $50,000 per accident for bodily injury
  • $10,000 per accident for property damage

Uninsured Motorist Coverage:

  • $25,000 per person for bodily injury
  • $50,000 per accident for bodily injury
  • $5,000 per accident for property damage

Liability insurance covers damages or injuries you cause to others in an accident. At the same time, uninsured motorist coverage protects you if you’re involved in an accident with a driver who lacks insurance.

Maryland Car Insurance Requirements

Maryland also has strict car insurance requirements to protect drivers and passengers. The minimum coverage required is:

Liability Insurance:

  • $30,000 per person for bodily injury
  • $60,000 per accident for bodily injury
  • $15,000 per accident for property damage

Uninsured/Underinsured Motorist Coverage:

  • Same minimums as liability coverage

PIP coverage is not mandatory in Maryland but must be waived in writing by the policyholder.  It helps pay for medical expenses, lost wages, and other costs arising from an accident, regardless of fault. Maryland’s insurance laws are designed to ensure that drivers have access to necessary resources after an accident.

One important note: Maryland requires insurers to offer enhanced uninsured motorist coverage, which allows you to recover additional compensation in certain situations. While not mandatory, this coverage can provide extra protection.

Virginia Car Insurance Requirements

Virginia differs from both Washington, D.C., and Maryland in one significant way: it allows drivers to pay an uninsured motorist fee instead of purchasing car insurance. This fee costs $500 annually and permits drivers to operate their vehicles legally without insurance. However, it’s a risky option, as uninsured drivers remain personally liable for damages or injuries caused in an accident.

For those who choose to carry insurance, Virginia’s minimum requirements are:

Liability Insurance:

  • $30,000 per person for bodily injury
  • $60,000 per accident for bodily injury
  • $20,000 per accident for property damage

Uninsured/Underinsured Motorist Coverage:

  • Same minimums as liability coverage

In Virginia, Medical Expense and Medical Payments coverages are optional, and can provide an additional source of recovery.

Consequences of Driving Without Insurance

Failing to meet the car insurance requirements in any jurisdiction within the DC Metro area can lead to serious consequences, including:

  • Fines and Penalties: Uninsured drivers face significant financial penalties. For example, in Washington, D.C., driving without insurance can result in fines of up to $2,500 and suspension of your vehicle registration.
  • License Suspension: Maryland and Virginia impose license suspensions for uninsured drivers, creating additional hurdles to regaining driving privileges.
  • Legal Liability: Uninsured drivers are personally liable for damages or injuries caused in an accident, which can lead to devastating financial consequences.

What to Do After a Car Accident

Car accidents can happen at any time, even to the most cautious drivers. If you’re involved in an accident in the DC Metro area, taking the following steps can protect your rights:

  • Call the Police: File a police report, even for minor accidents. This documentation is critical for insurance claims and legal proceedings.
  • Exchange Information: Collect all involved parties’ names, contact details, and insurance information.
  • Document the Scene: Take photos of the vehicles, damage, and any visible injuries.
  • Seek Medical Attention: Some injuries may not be immediately apparent, even if you feel fine. A medical evaluation ensures your health is prioritized and creates a record of your condition.
  • Contact an Attorney: If you’ve suffered injuries or significant damage, an experienced car accident attorney can help you navigate the claims process and fight for fair compensation.
