If you are injured when you're a passenger in an Uber or a Lyft, you can bring a claim as you would if you are not in an Uber or a Lyft.

If the Uber or Lyft driver is at fault, you can still bring your claim, but it'll likely be covered by the Uber or Lyft insurance. Each of those companies provides insurance to their drivers.

If another driver is at fault, you can bring your claim against them like you otherwise would.

So being involved in an accident with an Uber or Lyft driver doesn't have any real effect on the damages to which you're entitled.
